1. Acceptance of Terms
By accessing and using podiatryboost.com (the "Website"), you accept and agree to be bound by these Terms of Service. If you do not agree, please do not use this Website.
2. Services Description
Podiatry Boost provides digital marketing services exclusively for podiatry practices in the United States, including but not limited to:
- Search engine optimization (SEO)
- Paid advertising management (Google Ads, Meta Ads)
- Social media marketing
- Website design and development
- CRM setup and automation
- Reputation management
- Content marketing
- AI video production
3. Service Agreements
Specific terms for marketing services are governed by a separate Service Agreement entered into between Podiatry Boost and the client practice. In the event of a conflict between these Terms of Service and a specific Service Agreement, the Service Agreement governs.
All monthly service plans are on a month-to-month basis unless otherwise specified in a Service Agreement. Cancellation requires 30 days written notice.
4. Payment Terms
Monthly service fees are billed in advance on the first of each month. Setup fees are due upon execution of the Service Agreement. All fees are in USD.
Advertising spend (Google Ads, Meta Ads) is billed directly to the client's ad accounts and is separate from management fees.
Late payments may result in suspension of services. Accounts unpaid for more than 30 days may be subject to a late fee.
5. Client Responsibilities
Clients agree to:
- Provide accurate and complete information about their practice
- Review and approve content before publication
- Maintain ownership of their advertising accounts and website
- Not engage other agencies for conflicting services without disclosure
- Comply with all applicable laws, including HIPAA
6. Intellectual Property
Upon full payment, clients own all content and creative assets produced specifically for them under a Service Agreement. Podiatry Boost retains the right to use anonymized campaign data and aggregated insights for internal research and marketing purposes.
The Podiatry Boost name, logo, and proprietary methodologies remain the intellectual property of Podiatry Boost.
7. Confidentiality
Both parties agree to maintain the confidentiality of proprietary information shared during the service relationship, including practice financials, patient data, and marketing strategies.
8. HIPAA and Patient Data
Podiatry Boost does not receive or process Protected Health Information (PHI) through this website. Clients are responsible for ensuring that their use of any tools or integrations we configure complies with HIPAA requirements. Where required, we will enter into a Business Associate Agreement (BAA).
9. Limitation of Liability
Podiatry Boost is not liable for indirect, incidental, special, or consequential damages arising from the use of our services. Our total liability is limited to the fees paid in the three months preceding the claim.
We do not guarantee specific search rankings, review counts, patient volumes, or revenue outcomes. Marketing results depend on many factors outside our control.
10. Termination
Either party may terminate services with 30 days written notice. Podiatry Boost reserves the right to immediately terminate services for non-payment or material breach of these terms.
Upon termination, all client-owned assets (ad accounts, website files, content) will be transferred to the client within 14 business days.
11. Governing Law
These Terms are governed by and construed in accordance with applicable law. Any disputes shall first be attempted to be resolved through good-faith negotiation.
12. Changes to Terms
We may update these Terms of Service from time to time. Continued use of our website or services after changes constitutes acceptance of the updated terms.
